Export controlsand what canbe published
In defense, publication is regulated, so press material is treated as a possible export. We never ask for controlled data.
Messages are built from what is already public or cleared, and your export compliance officer approves the final text.
United States
ITAR covers defense articles and technical data, and posting controlled data online without authorization counts as an export. Under the EAR, published information, open to the public with no limits on further sharing, is generally not subject to the rules under 15 CFR 734.7, with exceptions such as some encryption software, so your export compliance officer confirms each item.
European Union
The 2021 Dual Use Regulation covers technology sent electronically. Public domain information is exempt, as is basic research. Design and production know how that is not public may need an export licence, depending on how the technology is classified.
Ukraine
Article 114-2 of the Criminal Code, in force since 27 March 2022 and amended in April 2022, punishes spreading information under martial law or a state of emergency on weapons deliveries to Ukraine, or on force movements and positions that can be identified on the ground, before an authorised source has made it public. The term depends on the part of the article, three to five years for deliveries, five to eight for force movements and eight to twelve in aggravated cases, such as a group acting by prior agreement, for gain or for the aggressor.

The company pays. Brave1 grants run up to 8 million hryvnias for a combat tested product, and they list marketing among prohibited costs.

Yes. A mutual NDA comes before any technical or commercial detail. Choose the NDA option in the form and the first call is scheduled only after signature.
Can PR material include export controlled technical data?
No. Under US ITAR and EAR rules and the EU dual use regulation, publishing controlled technology can itself count as an export. We work only with information that is already in the public domain or cleared for release.
What can a Ukrainian defense company publish under martial law?
Article 114-2 of the Criminal Code makes it a crime under martial law to disclose weapons deliveries, or the movement and positions of forces where they can be identified on the ground, unless an authorised source, such as the General Staff or the Ministry of Defence, has already made them public. Anything touching combat use is checked against that rule and your customer's guidance.
Can Brave1 grant money pay for PR?
No. Brave1 puts marketing on its list of prohibited costs. Rent and business trips are on the same list. PR is paid from the company's own budget or from investor money.
Which defense exhibition is best for a Ukrainian company?
Eurosatory in Paris in even years and DSEI in London in odd years reach the widest European audience. MSPO in Kielce is the closest Central European market. UCDI coordinates a national ZBROYA presence at key international shows.
